| 1. | Definitions and Interpretation |
| 1.1 | In these Specific Terms and Conditions, the following words and expressions shall have the following meanings: "Acceptable Use Policy" means the guidelines for acceptable conduct and use of the Service located at the SingTel website at www.singtel.com, including all subsequent revisions or amendments. "Customer" means any person who applies for or subscribes for or utilises the Service. "General Terms" means Singapore Telecommunications Limited's General Terms and Conditions of Service. "Law" has the meaning set out in the General Terms and, for the avoidance of doubt, includes the Broadcasting (Class Licence) Notification and Broadcasting Act (Cap 28) including all amendments and revisions thereto from time to time in force and all rules and regulations made thereunder and the rules, regulations, codes of practice, guidelines and directions of the Media Development Authority of Singapore made under or pursuant to any law in force in the Republic of Singapore, including the Code of Practice for Market Conduct in the Provision of Mass Media Services. "Minimum Subscription Period" means the minimum period for which the Customer must subscribe for the Service, as specified in Clause 2.1. "Mobile Line" means a telecommunications line for use to make or receive calls, or to send or receive material, from a mobile cellular phone or other wireless device. "Service" means the provision and/or maintenance by SingTel Mobile of a Mobile Line and any additional services as may be offered or provided by SingTel Mobile. "SingTel Mobile" means SingTel Mobile Singapore Private Limited and its successors. |
| 1.2 | The words and expressions used in these Specific Terms and Conditions, which are defined in the General Terms but are not defined in these Specific Terms and Conditions shall have the same meanings as defined in the General Terms unless the context otherwise requires. |
| 1.3 | The headings or titles to the Clauses in these Specific Terms and Conditions are to facilitate reference and shall not be referred to or relied upon in the construction of any provision of these Specific Terms and Conditions. |
| 2. | Duration of Service and Termination |
| 2.1 | The Minimum Subscription Period for the Service shall be: (a) a period of three (3) months; or (b) such other period as may be stipulated by SingTel Mobile as the Minimum Subscription Period before or when the Customer applies for the Service. Thereafter the Service shall continue in force until terminated by the Customer or SingTel Mobile. |
| 2.2 | Subject to Clause 2.3, SingTel Mobile or the Customer may terminate the Service by giving to the other not less than four (4) days’ prior written notice. |
| 2.3 | If the Service is terminated before the expiry of the Minimum Subscription Period by the Customer for any reason whatsoever, or by SingTel Mobile as a consequence of any breach by the Customer of any of the obligations or duties of the Customer then, despite any provision to the contrary in the General Terms, the Customer shall pay SingTel Mobile the difference between: a) the total Fees and Charges that SingTel Mobile would have imposed or charged the Customer for the Service, including without limitation for the use of the Service for the Minimum Subscription Period, had the Service not been terminated prior to the expiry of the Minimum Subscription Period; and b) the total amount paid by the Customer to SingTel Mobile as subscription and usage fees or charges for the Service for the period during which the Service was subscribed by the Customer; and any and all Fees and Charges that were discounted, waived or reduced by SingTel Mobile on the basis that the Customer had subscribed for, or would utilize, the Service for the Minimum Subscription Period may be reinstated and imposed by SingTel Mobile on the Customer retroactively as from the date of commencement of the Service. |
| 3. | SingTel Mobile's Management of Systems and Data
SingTel Mobile reserves the right to manage and control access to any computer or other electronic or telecommunications system operated or used by SingTel Mobile or linked to any computer or other electronic or telecommunications system operated or used by SingTel Mobile and any data stored therein in a manner deemed appropriate by SingTel Mobile and to delete any data (whether belonging to, provided or stored by the Customer or otherwise), notwithstanding that such access and the storage of such data is a requirement or constitutes a part of the Service. |
| 4. | Changes in Usage Plan
The Customer shall not change any usage or fee plan applicable to the Service without first notifying SingTel Mobile of the proposed change in writing, or through such other means as may be specified by SingTel Mobile, and obtaining SingTel Mobile's written consent. Any change consented to by SingTel Mobile shall take effect on the date specified by SingTel Mobile or, in the absence of any such specification, within seven (7) days of the date of SingTel Mobile’s written consent. |
| 5. | Use Of Service
The Customer shall use, and shall procure that any person the Customer permits or allows to use the Service shall use, the Service in accordance with the Acceptable Use Policy and with such other guidelines, rules and requirements as SingTel Mobile may issue from time to time or any Law. |
| 6. | Consent to Use and Disclose Customer Information and Data
The Customer agrees that SingTel Mobile shall be entitled to use or disclose any information or data disclosed by the Customer in accordance with Clause 15 of the General Terms located at the SingTel website at http://www.singtel.com (or available from SingTel Mobile on written request). The Customer is entitled to withdraw such consent in the procedure as prescribed by SingTel Mobile from time to time. |
| 7. | General |
| 7.1 | The Customer shall be bound by and shall fully observe and comply with all the General Terms as well as such other terms and conditions as may be agreed or accepted by the Customer. The rights and protections conferred on SingTel Mobile under these Specific Terms and Conditions shall be additional to the rights and protections conferred on SingTel Mobile under the General Terms and any other terms and conditions agreed or accepted by the Customer. |
| 7.2 | Any Clause in the General Terms, these Specific Terms and Conditions, or any other terms and conditions as may be agreed or accepted by the Customer, that is invalid, unenforceable or illegal shall be enforced as nearly as possible in accordance with its terms, but shall otherwise be deemed severed and shall not affect the enforceability of any other Clauses, which Clauses shall continue to be valid and enforceable to the fullest extent permitted by law. |
